Rules & Regulations for the Town of Plainville

Section Description
8- 1
In the following definitions the Plainville Fire Department will hereinafter be referred to as "P.F.D." as used throughout.
8- 2.1
"FIRE ALARM SYSTEM": Any manual or heat-activated, smoke-activated, flame-energy activated or other such automatic device capable of transmitting a fire alarm signal directly to the P.F.D. by way of a master box.
8- 2.2
"FIRE ALARM SYSTEM MALFUNCTION": The transmittal of a fire alarm signal to the P.F.D. by way of a master box on the protected property when there is no actual fire or other emergency and which results in a response from the Fire Department. A fire alarm system malfunction shall include an alarm signal which is caused as a result of mechanical defect in the operation of the fire alarm system or as a result of the failure of the owner/owners or their agents, including, but not limited to, a person hired by the owner/owners to maintain the fire protective system, to notify the Fire Departmenmt of repairs, maintenance, testing or other work being performed on the alarm system.
8- 2.3
"OWNER/OWNERS": Every person who alone or severally with others who; (a) has legal title to real estate, or a structure or premises on which a fire protective system is installed or on which such a system is required to be installed as determined by the P.F.D.; or (b) has care, charge or control of any such premises in any capacity including, but not limited to a tenant, lessee, occupant, agent, executor, administrator, trustee or guardian of the estate of the holder of legal title; or (c) mortgagee in possession of any such premises; or (d) agent, trustee or other person appointed by the courts for any such premises; or (e) any officer or trustee of the association of unit owners of a condominium. Each person is bound to comply with the provisions of this ordinance.
8- 2.4
"FIRE CHIEF": The Chief of the P.F.D. or any of his/her designated representatives that were appointed by him/her.
8- 2.5
"MASTER BOX OWNER/OWNERS": An individual or entity who has on his/her business or residential premises a fire alarm system equipped to send a fire alarm signal directly to the P.F.D. by way of a master box.
8- 2.6
"OTHER DEFINITIONS": All other definitions of the Town of Plainville Ordinance Chapter 10, Article 3, Fire Protective Systems Installation and Regulations, shall be included in this regulation.
8- 3
Every master box owner/owners whose fire alarm system is connected after the effective date of this ordinance, to the P.F.D. by way of a master box, shall pay the tie-in fee established by the Board of Selectmen in the Town of Plainville. Which is in the approved fee schedule.
8- 4
At the passage of this ordinance all fire protective systems shall comply with the conditions of: Section 1 - General, Section 7 - Inspections and Maintenance and Section 8 - Enforcement.
8- 5
If a fire alarm systems owner/owners fails to comply with Section 8-4, the P.F.D. may assess a fine of one hundred dollars ($100.00) for each day of non-compliance.
8- 6
Every fire alarm systems owner/owners shall be responsible for updating the information herein required to be provided to the P.F.D.. If the fire alarm systems owner/owners fail to comply with this section, the P.F.D. may assess a fine of one hundred dollars ($100.00).
8- 7
All violations of this requirement are subject to the fine structure in the Town of Plainville Ordinance Chapter 10, Article 3, Fire Protective Systems Installation and Regulations.
8- 8
All fire alarm system malfunctions are subject to the fine structure in this ordinance stated in Section 8-7. Any false fire alarms which is the result of the failure of the property owner/owners, occupants or their agents to notify the P.F.D. of repairs, maintenance or testing of the internal fire alarm system, within the protected premises, may cause a penalty to be assessed in accordance with this section.
8- 9
For the purpose of this ordinance, a fire alarm system malfunction shall be defined as follows, but not limited to:
8- 9.1
Operation of a faulty smoke or heat detection device.
8- 9.2
Faulty control panel or associated equipment.
8- 9.3
Water pressure surge in automatic sprinkler systems.
8- 9.4
Accidental operation of sprinkler system.
8- 9.5
An action by an employee of the owner/owners or occupants of the premises or a contractor employed by the owner/owners or occupants, causing activation of an internal fire alarm system with no fire.
8-10
A burn-in period of thirty (30) days from all final inspections will be granted during which time fines will be assessed only if alarms are a result of negligence.
8-11
The owner/owners will not be assessed a fine for a maliciously induced alarm, but a criminal complaint may be brought against the initiator of the alarm.
8-12
The Chief of the Plainville Fire Department may promulgate such regulations as may be necessary to implement this ordinance. The Fire Chief is authorized to pursue such legal action as may be necessary to enforce this ordinance.
8-13
The provisions of this ordinance shall be deemed to be severable, and if any of its provisions shall be held unconstitutional by any court of competent jurisdiction, the decision of such court shall not affect or impair any of the remaining provisions.
